These Terms of Use (the “Terms”) govern your access to and use of homesusa.com and the other websites, pages, newsroom content, downloads and forms we operate that link to these Terms (together, the “Site”). The Site is operated by HomesUSA.com, Inc. (“HomesUSA.com,” “we,” “us” or “our”), a Texas corporation licensed as a real estate brokerage in Texas and Florida.

By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. The Site and the SpecDeck® platform are different things

The Site is an informational website. It describes our services, publishes news and market data, and lets you contact us or request a demonstration.

The SpecDeck® platform, QuickFinder and any other product you sign in to are provided to our builder clients under a separate written service agreement. Where that agreement and these Terms conflict, the service agreement controls for that client’s use of the platform. Nothing on the Site amends a service agreement.

2. No brokerage relationship is created by using the Site

Browsing the Site, downloading content or submitting a form does not create an agency, brokerage, fiduciary or client relationship between you and HomesUSA.com, and does not obligate you to work with us or pay us anything. Any brokerage relationship exists only under a signed written agreement.

Texas law requires us to provide the Texas Real Estate Commission Information About Brokerage Services and Consumer Protection Notice. Links to both appear in the footer of every page.

3. Who may use the Site

You must be at least 18 years old to submit a form or otherwise provide personal information through the Site. By submitting a demo request, report request or other inquiry on behalf of a company, you represent that you are authorized to do so for that company.

5. Intellectual property

The Site and everything on it, including text, design, graphics, photographs, logos, reports, charts, data compilations, downloads and software, are owned by HomesUSA.com or its licensors and are protected by United States and international copyright, trademark and other laws. Except as expressly allowed in these Terms, you may not reproduce, distribute, modify, create derivative works from, publicly display or otherwise exploit any part of the Site without our prior written permission.

Trademarks. HomesUSA.com®, SpecDeck® and our logos are registered trademarks of HomesUSA.com, Inc. Other names and logos on the Site, including builder and media logos, belong to their respective owners and appear with permission or as nominative references. You may not use our marks without our written consent, except as described in Section 6.

Personal use license. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site and to print or download one copy of the materials on it for your personal or internal business evaluation of our services, provided you keep all copyright and trademark notices intact.

6. Press kit, news and market data

Press kit. Logos and other assets in our press kit may be used by journalists, industry publications, partners and clients for editorial purposes and to accurately refer to HomesUSA.com and SpecDeck®. Do not alter the logos, use them in a way that implies endorsement or affiliation that does not exist, or use them in any product, service or marketing without our written permission.

News and market data. Our newsroom, the Texas New Home Sales Index and other reports and statistics we publish (“Market Data”) are provided for general information only. You may quote or reproduce brief excerpts of Market Data with attribution to “HomesUSA.com” and, where online, a link to the Site. Market Data is derived from MLS and other sources we believe reliable, but we do not guarantee that it is complete, current or accurate, and it is not investment, legal, tax, lending or professional advice. Decisions you make in reliance on Market Data are your own.

MLS data. Listing information that may be displayed on the Site or on QuickFinder is supplied by multiple listing services that own that data and its copyright. Such information is intended only for consumers’ personal, non-commercial use to identify properties they may be interested in, may not be copied, redistributed or retransmitted, and may be monitored by the applicable MLS for compliance with its rules.

7. Information you submit

When you submit a form on the Site (for example a demo request, a price discrepancy report request, a Texas Index request or a media inquiry) you agree that the information is accurate, that we may contact you by email or phone about your request, and that we may use it as described in our Privacy Policy. Do not submit confidential information through the Site; our forms are not a secure channel for contracts, financial data or other sensitive material.

Any ideas, suggestions or feedback you send us about the Site or our services may be used by us without restriction or compensation to you.

8. Third-party sites and services

The Site links to and uses third-party sites and services, including scheduling (Calendly), social networks, builder and media websites, system status pages and the SpecDeck® sign-in. We do not control and are not responsible for the content, availability, security or privacy practices of any third party. Your use of a third-party service is governed by that third party’s terms.

We do not endorse or guarantee the products or services of any third party to whom we may refer you, including other brokers, agents, lenders or title and settlement companies.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT, DOWNLOADS AND MARKET DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE OR CURRENT. STATEMENTS ABOUT OUTCOMES OUR CLIENTS HAVE EXPERIENCED, INCLUDING TURNAROUND TIMES, SALES FIGURES AND TESTIMONIALS, DESCRIBE PAST RESULTS AND ARE NOT A PROMISE OF FUTURE PERFORMANCE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMESUSA.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. These limitations do not apply to a builder client’s rights under its service agreement.

11. Indemnity

You agree to defend, indemnify and hold harmless HomesUSA.com and its officers, directors, employees, agents and affiliates from and against any claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

If you believe material on the Site infringes your copyright, send a notice that complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent at the contact address in Section 16, including: identification of the copyrighted work and of the material you claim is infringing (with its URL); your contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature.

13. Governing law and disputes

These Terms and any dispute arising out of or related to the Site are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Dallas County, Texas have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue there. Any claim relating to the Site must be brought within one year after it arises or it is permanently barred, to the extent the law allows.

14. Changes to the Site and these Terms

We may change, suspend or discontinue any part of the Site at any time without notice. We may also revise these Terms from time to time by posting the revised version on the Site; the revised Terms take effect when posted, and your continued use of the Site after that is your acceptance of them. Material changes will be flagged on this page.

15. General

These Terms, together with the Privacy Policy, are the entire agreement between you and HomesUSA.com regarding the Site and supersede any prior terms posted on the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or successor. Sections 5, 6, 9, 10, 11, 13 and 15 survive any termination of your access to the Site.
